Terms and Conditions (as revised 16 March 2026)
1. Introduction
1.1 Governing Documents: These Terms and Conditions, as amended from time to time, and any rules (including the Constitution/Rules) published by The University of Canterbury Club Incorporated ("UCC") govern all aspects of UCC.
1.2 Basis of Membership: These Terms and Conditions, the Rules, and information contained within the Website form the basis of UCC membership.
1.3 Purpose: They are intended to protect you as a Member of UCC.
1.4 Precedence: In the event of any conflict between these Terms and Conditions and the Rules, the Rules shall prevail.
1.5 Member Responsibility: Your membership in UCC is governed by these Terms and Conditions and the Rules; it is your responsibility to read and understand them.
1.6 Clarification: Further clarification can be obtained from the Committee.
1.7 Awareness: Each Member of UCC is responsible for remaining aware of the Terms and Conditions and the Rules.
1.8 Publication: These Terms and Conditions are effective as of March 16, 2026, and may be amended from time to time.
1.9 Version Control: Refer to https://ucc.org.nz/terms-and-conditions/ for the current version.
1.10 Information Accuracy: Every effort is made to ensure information provided in relation to UCC is correct; however, to the extent permitted by law, UCC accepts no responsibility for any inaccuracy or misdescription.
2. Definitions
2.1 UCC: Means The University of Canterbury Club Incorporated, a New Zealand owned business for trading/registration purposes.
2.2 Card: Means the card and membership number issued by UCC to the Member.
2.3 Committee: Means the Committee of UCC, which is the governing body.
2.4 Member: Means the individual who has consented to become a Member and has been properly admitted to UCC in whose name the membership is maintained.
2.5 Member Benefits: Means events, discounts, services, or arrangements available to Members.
2.6 Membership Period: Commences on 1 December in any year and ends on 30 November in the following year.
2.7 Membership Fee: The annual amount payable as consideration for membership.
2.8 Sponsors and Partners: Persons or entities appointed as such by the Society.
2.9 Website: Means www.ucc.org.nz.
2.10 Working Day: Means any day as defined in the Legislation Act 2019, excluding Saturday, Sunday, and public holidays (Waitangi Day, Good Friday, Easter Monday, Anzac Day, the Sovereign's Birthday, Te Rā Aro ki a Matariki, and Labour Day).
2.11 Trading Holidays: For UCC trading purposes, Working Day also excludes the period commencing 25 December and ending on 5 January.
3. Interpretation
3.1 Clause Meanings: "Company" includes any body corporate, partnership, joint venture, or trust; "person" includes individuals or unincorporated bodies.
3.2 Time and Currency: References to months/years are calendar-based; times are New Zealand time; and currency is in New Zealand Dollars (NZD).
4. Types of Membership
4.1 Eligibility: Membership is open to individuals over 18 who meet the criteria in the Constitution, including University staff, retired staff, postgraduates (Masters Part II or PhD), alumni, and persons connected with the University as determined by the Committee.
5. Changes to Terms and Rules
5.1 Notice and Variation: UCC reserves the right at all times to vary the Terms and Conditions, or Member Benefits without notice. While UCC will use reasonable endeavours to advise Members of changes, it is not liable for a failure to do so.
5.2 Changes to the Constitution (the Rules) are made in accordance with the Constitution.
5.3 Deemed Receipt: Notice is deemed received if provided to the Member's address or posted on the Website.
6. Membership Admission
6.1 Application: Eligibility is determined through application to the Committee online or via paper form; paper forms may be submitted in person over the bar at the Ilam Homestead. Every applicant must consent in writing to becoming a Member.
6.2 Technical Failure: UCC assumes no responsibility for failure to receive a registration due to technical problems, internet malfunction, or incorrect email details supplied by Members.
6.3 External Factors: UCC assumes no responsibility for, and the Members release UCC from, any loss if events or administration are affected by causes beyond UCC's reasonable control, such as computer viruses, tampering, or unauthorized intervention.
6.4 Posting Notice: The names of applicants shall be posted on the Club's notice board for fourteen (14) clear days prior to election to allow for Member objections.
6.5 Enrolment: Each Member will be assigned a membership number and issued a Card.
6.6 Restrictions: Individuals may only hold one membership, which is non-transferable.
6.7 Card Security and Verification: Members must keep the Card secure. To maintain the security of membership information, UCC utilizes the Member’s surname, date of birth, date of joining, mailing address, and/or recent attendance at events. In the event of loss, theft, or unauthorized use, the Member must advise the Committee immediately.
6.8 Impact of Breach: Any breach of these Terms and Conditions, whether intentional or otherwise, may result in termination of membership or cancellation of Member Benefits.
7. Membership Fee and Financial Obligations
7.1 Payment: Payable at the commencement of a Membership Period; renewing members must pay prior to the new period.
7.2 Fee Setting: Membership Fees are determined and set by resolution at a General Meeting.
7.3 Activation: No person is accepted as a Member until the fee is received in full.
7.4 Voiding Acceptance: If payment is not made within two months of approval, the acceptance shall be void.
7.5 Billing: Transactions are billed in NZD; online payments appear as "ILAM HOMESTEAD" on statements.
7.6 Credit Card Processing: Details are not stored on UCC systems; they are processed securely by a third-party provider, DPS (Payment Express Limited).
7.7 Provider Terms: Members may refer to the DPS privacy policy regarding transaction security.
7.8 Refunds: No refunds of Membership Fees will be issued for any reason.
7.9 Arrears: Any Member failing to pay within 10 Working Days of the due date is considered unfinancial and loses all membership rights until arrears are paid.
7.10 Termination for Arrears: If arrears are not settled within 10 Working Days of the due date, the Committee may begin the process to terminate membership in accordance with the Constitution.
8. Use of Card and Member Benefits
8.1 Agreement: Use of the Card constitutes agreement to be bound by these Terms.
8.2 Property: The Card remains the property of UCC and must be returned on demand.
8.3 Card Nature: The Card is strictly for identification and access; it is not a payment card.
8.4 Validity: The Card is valid for use only by the Member and only during the period indicated on it.
8.5 Security: Members must keep the Card secure; in the event of loss, theft, or unauthorized use, the Member must advise the Committee immediately.
8.6 Liability: The Member is liable for all use of the Card until UCC is notified; UCC is not liable for misuse of lost/stolen cards.
8.7 Discretion: UCC reserves the right to withdraw, cancel, or change Member Benefits at any time without liability for loss or damage.
8.8 Replacements: A fee may apply for replacement cards.
9. Third-Party Suppliers
9.1 Agent Status: UCC acts solely as an agent for benefits provided by third-party suppliers.
9.2 Supplier Terms: Provision is subject to the supplier's terms; claims must be made directly to the supplier.
9.3 Refusal and Costs: UCC is not liable if a supplier refuses to honor the Card; members are liable for all costs/claims arising from using third-party benefits.
10. Termination and Cessation
10.1 Disciplinary Process: All disciplinary matters or revocations must follow the formal dispute resolution process in Schedule 5 of the Constitution, guaranteeing the right to be heard.
10.2 Causes: Membership may be terminated for abuse of facilities, acting detrimentally to UCC interests, supplying misleading information, or bringing UCC into disrepute.
10.3 Resignation: A Member may cease membership by expressing so in writing to the Committee.
10.4 Post-Cessation Obligations: Resigned or terminated members remain liable for fees until the next balance date (Nov 30). All UCC property, including the Card, must be returned upon demand or within 5 Working Days of membership cessation.
11. General Legal Provisions
11.1 Force Majeure: UCC has no liability for performance failure or website unavailability arising from causes beyond its reasonable control.
11.2 No Waiver: Failure to enforce a right does not constitute a waiver.
11.3 Severability: If any provision is held illegal or invalid, it shall be severed, and the remaining terms shall continue in full effect.
11.4 Liability Release: UCC shall not be liable for any loss, damage, or injury suffered (including direct or consequential loss or loss arising from negligence) arising in connection with events run by UCC.
11.5 Intellectual Property: UCC owns all proprietary and IP rights in the Website and underlying software; unauthorized reproduction or commercialization is prohibited.
11.6 Governing Law: These terms are governed by the laws of New Zealand.
11.7 Consumer Guarantees Act: The CGA 1993 does not apply where membership is for business purposes; for non-business members, terms contrary to the CGA are deemed omitted.
12. Data Privacy
12.1 Compliance: UCC collects and manages personal information in accordance with the Privacy Act 2020.
12.2 Authorised Use: UCC uses information to provide benefits, verify identity, and for internal research and marketing. This includes collecting information relating to your use of the Website, the content you access, and the use of cookies to maintain secure sessions when you are logged into your account to update your details
12.3 Marketing Authorizations: Members authorize UCC to use their information for marketing products or services of UCC’s Sponsors and Partners.
12.4 Disclosure to Agents: UCC may disclose information to related bodies corporate, agents, or contractors for research, marketing, and product development.
12.5 Indirect Collection: Where UCC collects information from a third party (e.g., verifying University status), it will take reasonable steps to notify the Member of the purpose.
12.6 Publicity: Members agree to be identified by name and photograph for promotional purposes without compensation, with copyright vesting in UCC.
12.7 Access and Privacy Restrictions: Members may request access to or correction of their personal information by contacting the Secretary at secretary@ucc.org.nz. To protect member privacy, only the individual Member named on the account is entitled to access that account's specific information.

Ticket Purchase Terms & Conditions of Sale
1. Agreement, Final Sale, and Refund Methods: All purchases are final; no refunds, exchanges, or cancellations are permitted except as required by New Zealand law.
2. Refund Methods: If an event is cancelled, purchasers should contact UCC for instructions on the refund procedure. UCC retains the right to issue authorized refunds directly to the credit card used for the original purchase.
3. Delivery: Tickets are delivered on-screen following payment or via confirmation email.
4. Profile Access: Purchasers may also view and print tickets from their UCC website profile under "Tickets".
5. Purchaser Responsibility: It is the purchaser's responsibility to notify UCC if no ticket purchase confirmation is received. If you do not inform UCC that you have not received confirmation, UCC is unable to guarantee that your purchase was successful, which may result in you being unable to attend if the event sells out.
6. Security: Look after tickets like cash; the unique code can be redeemed only once.
7. Multiple Copies: If multiple copies of the same ticket code are presented, UCC may refuse entry to all holders presenting that code.
8. Pricing: Prices are in NZD and include GST.
9. Banking: UCC is not responsible if banks deny transactions based on account status. Please note that in these instances, it is your bank denying your card (not UCC) and you should contact your bank for a resolution.
10. Limits: Tickets may be subject to purchase limits per customer to restrict unfair practices.
11. Postponement: If an event is postponed, tickets remain valid for the new date.
12. Weather: Refunds/cancellations due to weather are at the sole discretion of UCC as events can be moved inside the Ilam Homestead; no automatic right to a refund exists.
13. Program Changes: UCC reserves the right to replace artists and amend programs or seating without notice.
14. Member Tickets and Database Verification: Holders of member tickets to events must be fully paid-up financial members on both the date of purchase and the date of the event. To ensure eligibility, UCC reserves the right to verify membership status against the Club’s database upon entry. Valid ID or a current UCC Membership Card must be presented on demand.
15. Impact of Unverified Status: If a ticketholder’s membership status cannot be verified via the database or physical ID, UCC may, at its sole discretion, refuse admittance or charge the difference between member and non-member ticket prices prior to entry.
16. Concession ID: When presenting concession tickets, appropriate identification must be shown or admittance may be refused.
17. Third-Party Awareness: Purchasers of tickets for others (including minors) acknowledge those parties are aware of all terms regarding entry and attendance.
18. Conduct and Ejection: Attendees must comply with all security requirements; prohibited items (outside alcohol, weapons) will be confiscated. UCC reserves the right, without refund or compensation, to refuse admission or eject any person for behaviour that is abusive, disorderly, or disruptive - including, but not limited to, fighting or hampering the conduct of the event. This right of refusal or ejection also extends to instances where tickets are found to be lost or damaged.
19. Resale: Tickets may not be resold at a premium or used for unauthorized commercial purposes; breach results in refusal of admission.
